Free Photography Sessions - Terms of Use

By booking or participating in a free photography session through this website, you agree to the following terms and conditions:

1. Free Service
All sessions are provided completely free of charge as part of the photographer's portfolio development. No payment, compensation, or other financial obligation is expected or guaranteed unless specifically agreed upon in writing beforehand.

2. Photographer's Right to Use Images
Because these sessions are offered at no cost, the photographer reserves the full right to select, edit, keep, publish, display, distribute, and use images from the session for professional purposes including but not limited to: portfolio websites, social media platforms, marketing materials, self-promotion, editorial features, and any other promotional or professional use. This permission is granted in exchange for receiving free photography services.

3. No Right of Approval
You do not have approval or veto rights over the photographer's use of the images. The photographer may choose which images (if any) to use publicly and makes all creative decisions regarding editing, cropping, and presentation.

4. Editing and Delivery Timeline
Any photo editing, retouching, color correction, or post-processing is provided entirely at the photographer's discretion. When editing is offered, it may take up to 30 days or longer depending on scheduling, workload, and availability. No specific delivery timeline is guaranteed.

5. No Guarantee of Results or Quantity
Photography is an artistic and creative process. No guarantee is made regarding the aesthetic outcome, number of final images delivered, specific poses or styles achieved, technical quality, or your personal satisfaction with the results. The photographer is actively learning and improving through these portfolio sessions.

6. Travel Availability
The photographer may travel for sessions within reasonable distance around the Duisburg, Köln, Bonn, and greater NRW area. Travel availability depends on timing, distance, transportation costs, and scheduling. Any significant travel expenses beyond local NRW travel may require reimbursement if agreed in advance.

7. Language
All communication, instructions, and services are provided exclusively in English. Clients are responsible for providing their own translation support if needed.

8. Client Responsibilities
Clients agree to arrive on time, follow directions, cooperate fully during the session, and conduct themselves appropriately. Session quality may be affected by factors outside the photographer's control including weather, lighting conditions, location access, wardrobe choices, and subject cooperation.

9. Liability Limitation
To the maximum extent permitted by law, the photographer is not responsible for any indirect, incidental, consequential, or punitive damages arising from free sessions including but not limited to dissatisfaction with results, scheduling conflicts, equipment issues, file loss, or creative decisions. Liability is limited to rescheduling when possible, given the free nature of the service.

10. Cancellation Policy
Either party may cancel or reschedule free sessions at any time. The photographer reserves the right to decline any session request for creative, safety, scheduling, legal, or personal reasons without explanation.

11. Model Release Requirement
A signed consent form is required from all adult participants before any photography session begins. This website notice serves as general information only and does not replace individual written consent.

Kostenlose Fotoshootings - Nutzungsbedingungen

Durch Buchung oder Teilnahme an einem kostenlosen Fotoshooting über diese Website stimmen Sie folgenden Bedingungen zu:

1. Kostenloser Service
Alle Shootings werden komplett kostenlos im Rahmen der Portfolio-Entwicklung des Fotografen angeboten. Keine Zahlung, Vergütung oder andere finanzielle Verpflichtung wird erwartet oder garantiert, es sei denn schriftlich anders vereinbart.

2. Nutzungsrechte des Fotografen
Da diese Shootings kostenlos angeboten werden, behält sich der Fotograf das volle Recht vor, ausgewählte Bilder zu bearbeiten, zu behalten, zu veröffentlichen, anzuzeigen, zu verteilen und für berufliche Zwecke zu nutzen, einschließlich aber nicht beschränkt auf: Portfolio-Websites, Social Media, Marketingmaterialien, Selbstwerbung, redaktionelle Features und jegliche andere promotional oder professionelle Nutzung.

3. Kein Vetorecht
Sie haben kein Genehmigungs- oder Vetorecht bezüglich der Nutzung der Bilder durch den Fotografen. Der Fotograf entscheidet frei über die Auswahl, Bearbeitung, Beschnitt und Präsentation der Bilder.

4. Bearbeitungszeit
Jegliche Bildbearbeitung, Retusche, Farbkorrektur oder Postproduktion erfolgt nach freiem Ermessen des Fotografen. Geplante Bearbeitung kann bis zu 30 Tage oder länger dauern je nach Zeitplan, Arbeitsbelastung und Verfügbarkeit.

5. Keine Garantie für Ergebnisse
Fotografie ist ein kreativer Prozess. Es wird keine Garantie für ästhetische Ergebnisse, Bildanzahl, spezifische Posen oder Stile, technische Qualität oder persönliche Zufriedenheit gegeben. Der Fotograf ist lernend und verbessert sich kontinuierlich.

6. Reiseverfügbarkeit
Der Fotograf kann im Rahmen Duisburg, Köln, Bonn und NRW reisen. Verfügbarkeit hängt von Zeitpunkt, Entfernung, Transportkosten und Planung ab. Außergewöhnliche Reisekosten können bei vorheriger Absprache erstattet werden müssen.

7. Sprache
Alle Kommunikation, Anweisungen und Dienstleistungen erfolgen ausschließlich auf Englisch. Kunden sind für eigene Übersetzungsunterstützung verantwortlich.

8. Kundenpflichten
Kunden verpflichten sich, pünktlich zu erscheinen, Anweisungen zu befolgen, voll zu kooperieren und sich angemessen zu verhalten. Die Bildqualität kann durch wetterbedingte, lichttechnische oder kooperationsbedingte Faktoren beeinträchtigt werden.

9. Haftungsbeschränkung
Soweit gesetzlich zulässig haftet der Fotograf nicht für indirekte, zufällige, nachfolgende oder Strafschäden aus kostenlosen Shootings. Haftung beschränkt sich auf Nachbesprechung der Termine bei freier Leistung.

10. Stornierungsrichtlinie
Beide Parteien können kostenlose Termine jederzeit stornieren oder verschieben. Der Fotograf behält sich das Recht vor, Anfragen aus kreativen, sicherheits-, planungs-, rechtlichen oder persönlichen Gründen abzulehnen.

11. Einverständniserklärung erforderlich
Eine unterschriebene Einverständniserklärung ist vor jedem Shooting von allen erwachsenen Teilnehmern erforderlich.
